Content removal upon request

1. How Site content is formed

1.1. A significant part of the content of the website aiqazaqstan.com (hereinafter — the Site) is generated using automated means to collect and process publicly available information posted in open sources: on media websites, government bodies and organizations, and in public channels and communities. Third-party materials are accompanied by an indication of the source and a link to it.

1.2. Source selection and material processing are performed predominantly automatically, so the Site Administration cannot verify every material before publication for compliance with the rights and legitimate interests of third parties.

1.3. The Administration acts in good faith, does not intend to infringe the rights of third parties, and recognizes the right of rights holders and other interested persons to object to the placement of materials and information on the Site.

2. Who may submit a request

2.1. A request may be submitted by a person who believes that the placement of a material or information on the Site affects their rights or legitimate interests, including:

• a rights holder of a work (text, photograph, video) or their representative;
• an individual whose information is published on the Site, including registry person pages;
• a legal entity whose information is published on the Site, including registry company pages;
• a source owner who does not wish their materials to be collected and displayed on the Site.

2.2. Submitting a request does not require prior proof of infringement.

3. How to submit a request

3.1. A request is submitted via the form on this page or to and must include:

1. a)a link (links) to the Site page with the material or information;
2. b)a description of which materials or information are the subject of the request;
3. c)the basis for the request: rights in a work, information about oneself, inaccuracy of information, or the source owner's unwillingness to participate in aggregation;
4. d)for a rights holder — a link to the original material and information allowing rights to be established; for a representative — information about authority;
5. e)surname, name (organization name) and contact details for a response.

3.2. The Administration may request additional information if the subject of the request or the applicant's authority cannot be established without it. Identity documents are not requested by email.

4. Procedure and time limits

4.1. Within 2 (двух) business days from receipt of a request containing the information specified in clause 3.1, the Administration restricts access to the specified materials or information for the period of review.

4.2. Within 10 (десяти) business days from receipt of the request, the Administration reviews it and informs the applicant of the decision taken: removal of the material or information, correction thereof, or restoration of access with reasons stated.

4.3. Requests from personal data subjects for amendment, blocking or destruction of personal data are reviewed within the time limits established by the Law of the Republic of Kazakhstan On Personal Data and Their Protection, if those time limits are shorter than those specified above.

4.4. Upon a request from a source owner, the Administration removes previously published materials of the source and excludes the source from automated collection. The source may also prohibit collection by technical means (robots.txt file); such prohibitions are respected during collection.

4.5. Materials and information removed upon request are not restored during repeated automated collection.

5. Other provisions

5.1. Review of a request and removal of a material do not constitute an admission by the Administration of infringement of the applicant's or third parties' rights.

5.2. The Administration may refuse removal if placement of the material or information is permitted by the legislation of the Republic of Kazakhstan, including if the information constitutes official documents or reports of events and facts of an informational nature, or if the request is submitted by a person without confirmed authority. Refusal is accompanied by reasons.

5.3. Submitting a request does not deprive the applicant of the right to protect their rights by other means provided by the legislation of the Republic of Kazakhstan.

5.4. Requests to restrict access to information received from authorized government bodies are fulfilled in the procedure and within the time limits established by the legislation of the Republic of Kazakhstan.

5.5. Personal data specified in a request are processed in accordance with the Privacy policy solely for the purpose of reviewing the request.
